These terms apply to this website and products supplied by Lightning Australia Pty Ltd (ABN 73 676 591 512), trading as AQUAOZZY (“AQUAOZZY”, “we”, “us” or “our”). By using the website or placing an order, you agree to these terms. Nothing in these terms excludes, restricts or modifies a right or remedy that cannot lawfully be excluded, including applicable rights under the Australian Consumer Law.
Website information
We aim to keep descriptions, photographs, specifications, availability and pricing accurate. Screen settings and lighting can affect the appearance of Monument and Surfmist finishes. Product information may be updated from time to time. If a material error affects an order, we will contact you and offer an appropriate solution, which may include confirming a correction or cancelling and refunding the affected order.
Orders and acceptance
An order submitted through the website is an offer to purchase. An automated acknowledgement does not necessarily mean we have accepted the order. Acceptance occurs when we confirm the order for fulfilment. We may decline or cancel an order before acceptance where a product is unavailable, pricing or product information is materially incorrect, delivery is not serviceable, payment is not authorised, or we reasonably suspect fraud or misuse. If payment has been taken for a cancelled order, it will be refunded using the available original payment method.
Pricing and payment
Unless stated otherwise, website prices are in Australian dollars and include GST. Current system supply options are $1,299 for Adelaide pickup, $1,399 for Melbourne pickup, or $1,499 for metro Australia delivery. The genuine replacement filter pack is $249 and the stainless steel stand is $180, including GST. Installation is not included in these prices.
You must provide complete and accurate billing, contact and fulfilment information. Payment may be handled by an external payment provider and is also subject to that provider’s terms.
Pickup and delivery
System pickup is available from Adelaide or Melbourne as offered at checkout or confirmed by us. Metro Australia delivery is subject to address serviceability. Contact AQUAOZZY before ordering if you are unsure whether delivery is available to your address. Any timing we provide is an estimate unless we expressly agree otherwise. We will communicate known material delays.
You are responsible for providing safe and reasonable access, correct delivery details and an authorised recipient where needed. Risk and title pass in accordance with applicable law and the agreed fulfilment method.
Installation and site suitability
AQUAOZZY products must be installed and serviced by a licensed plumber in accordance with applicable plumbing requirements, product instructions and WaterMark documentation. A plumber must assess site suitability, connections, clearances and any additional work. Installation and related plumbing work are separate from the advertised product supply prices unless expressly included in a written quotation.
Product care and replacement filters
You must follow the supplied installation, use and maintenance guidance. AQUAOZZY generally recommends replacing the three-stage filter set every six months, although actual timing can vary with household usage and local water conditions. Failure to install, use or maintain the product correctly may affect performance and any warranty claim, to the extent permitted by law.
Warranty and consumer rights
The AQUAOZZY whole-house filtration system includes a three-year warranty, subject to the warranty terms supplied with the product, correct installation and required maintenance. This express warranty is in addition to any non-excludable rights and remedies under the Australian Consumer Law. For a warranty or consumer-guarantee concern, contact us with your order details and a clear description of the issue.
Returns and refunds
Returns, replacements and refunds are handled in accordance with our Returns and Refunds Policy and applicable law. Contact us before sending a product back so we can provide instructions and avoid unnecessary freight or delay.
Acceptable website use
You must not misuse the website, attempt unauthorised access, interfere with security or operation, introduce malicious code, scrape the service in a way that creates an unreasonable load, or use website content unlawfully. Product photographs, branding, copy and other website materials are owned by us or used with permission and may not be reproduced commercially without authorisation.
Liability
To the extent permitted by law, we are not responsible for loss caused by unauthorised alterations, installation or servicing that does not follow applicable requirements, misuse, failure to maintain the product, or information you provide that is incomplete or incorrect. Where liability can lawfully be limited, our liability is limited only to the extent permitted by applicable law. This clause does not limit non-excludable consumer rights.
Changes and governing law
We may update these terms for future website use or orders. The terms in effect when an order is accepted apply to that order unless a change is required by law or agreed with you. These terms are governed by the laws of South Australia, Australia, and the parties submit to courts with jurisdiction there, without restricting any rights you may have to bring a claim elsewhere under applicable consumer law.
